Deep linking can still get you sued.

A Texas judge ruled recently that linking directly to a publisher’s audiocast “is not a ‘fair use’ of copyright material.”

The ruling doesn’t surprise me. This isn’t just a case of deep linking to a page. It’s a case of linking to a file and thus removing the surrounding advertising.

What does surprise me is that the publisher/producer can’t figure out how to redirect traffic coming from the “offending party” to the front page of his site. SFX doesn’t need a lawyer, they need a web developer.
